General Conditions of Sale (GCS) for purchases made online on the website www.scaliagroup.com
Scalia Group Srl with headquarters in via Maresciallo Caviglia 10, 90143 Palermo, tel. +39 3496625672, e-mail: info@scaliagroup.com (“ Scalia Group ”) invites users to read these General Conditions of Sale (“ GTC ”) which regulate the purchase of products and the management of orders placed on the site.
1. Conclusion of the contract and delivery of the products
1.1 Every order placed on www.scaliagroup.com implies the conclusion of a sales contract in Italian between the buyer and Scalia Group.
1.2 By clicking on the “Complete order” button, the customer places a binding order for the items in the virtual cart. Once the order has been sent, Scalia Group will send the customer an order confirmation email within 1 hour. The sales contract is considered concluded between Scalia Group and the customer when the latter receives the order confirmation.
1.3 Where the products subject to the order are not available for reasons beyond the control of Scalia Group, the latter shall promptly notify the customer. In such a case, Scalia Group shall have no obligation to deliver the goods ordered.
In any case, if the products ordered are not available, Scalia Group will refund the customer any sum already paid.
1.4 Scalia Group does not assume responsibility for having to search for and obtain unavailable products from other sources. Scalia Group is only obligated to deliver what is available in stock and what has been ordered from its suppliers. The Scalia Group warehouse also includes the Scalia Bags stores, from which the products ordered by the customer come. Scalia Group delivers worldwide. If the delivery time is expressed in working days, this means all days between Monday and Friday included, with the express exclusion of any public holidays.
2. Prices and shipping costs
2.1 The customer is required to pay the price published on the product page at the time of sending the order. The price indicated is final and includes VAT.
2.2 Shipping costs are free for orders over €39.
2.3 All orders will be processed within 24 business hours of receipt.
2.4 The package usually takes 2 to 5 working days from the date of shipment to reach its destination. Scalia Group will not be responsible for delays attributable to the courier and not, such as strikes, accidents and natural disasters.
2.5 Any taxes, customs duties and VAT payments due due to shipments made outside the European Community are entirely the responsibility of the recipient and are established by the Customs Inspectors based on the laws in force in the country of destination.
2.6 Any additional costs due to storage, change of address and rejection of a package are entirely the responsibility of the recipient and will be deducted from the refund in the event of a return or paid directly to the courier upon delivery.
3. Payment
3.1 Scalia Group accepts various payment methods and, regardless of these, the customer is responsible for any costs associated with the transaction.
3.2 The payment methods are as follows:
- Cash on delivery: with this method the customer pays directly in cash upon delivery, without additional costs. For correct delivery of the package, it is useful to make sure that the data entered is correct and complete with all the elements to identify the delivery address (name on the intercom, staircase or internal). In case of return, a bank transfer will be made for the refund;
- Credit Card: credit and debit cards from the main circuits such as Mastercard, Visa, Visa Electron, Discover, American Express, Postepay are accepted. At the time of payment, the card data is transferred in complete safety through the SSL (Secure Sockets Layer) protocol. Orders with credit card will be processed as soon as the payment is credited and in the event of a return, the refund will be made using the same type of payment;
- PayPal: by choosing this payment method, the customer will be directed to the secure PayPal page to process the transaction. The order will be processed as soon as the payment is credited, in case of return the refund will be made via PayPal or on credit card in case of PayPal user not registered.
3.3 The buyer agrees to receive invoices/receipts and credits exclusively in electronic format. Purchase invoices will be issued exclusively upon request, to be sent by email to info@scaliagroup.com complete with all the data necessary for its issuance, including the order number.
4. Use of promotional vouchers
4.1 Promotional vouchers ("Discount Vouchers") cannot be purchased, are offered by Scalia Group as part of promotional campaigns and can be used for a limited period of validity.
4.2 Promotional vouchers can be used only once in relation to a single order, within the specified validity period. It is possible that the possibility of using promotional vouchers is excluded for the purchase of some products. Promotional vouchers cannot be used for the purchase of gift vouchers. It is possible that the use of a promotional voucher is subject to a minimum amount of expenditure.
4.3 The value of the products purchased must be equal to or greater than the value of the promotional voucher. If the amount of the promotional voucher is not sufficient to cover the value of the products ordered, the difference can be paid using any of the accepted payment methods referred to in the previous art. 3. Promotional vouchers are not refundable in cash and no interest will accrue on the credit represented by them. Promotional vouchers will not be refunded if the buyer decides to return part or all of the products ordered.
4.4 Promotional vouchers can only be used if the order is finalized, they cannot be used retroactively and cannot be transferred to third parties. Unless otherwise provided by Scalia Group, it is not possible to combine different promotional vouchers for the same order.
5. Use of gift vouchers
5.1 Gift cards may be purchased, and may be used to purchase products on the website. www.scaliagroup.com or in one of the Scalia Bags and Scalia Shoes stores, but not for the purchase of additional gift vouchers. If the value of the gift vouchers is not sufficient to cover the value of the products ordered, the difference can be paid using any of the accepted payment methods. If the value of the products purchased is lower than the value of the gift voucher, a new voucher will be issued with a value corresponding to the difference, which can be used later and in any case within the expiration date of the original voucher.
5.2 Gift vouchers can only be used before placing an order, they are not refundable for cash and the credit they represent does not accrue interest. Gift vouchers will be refunded if the buyer decides to return part or all of the products ordered, the refund will be exclusively in the form of a gift voucher.
6. Right of withdrawal
The customer has the right to withdraw from any order regarding products purchased on the website www.scaliagroup.com , without providing any reason. If the customer intends to return the purchased products, he/she can contact our Customer Service by telephone at +39 3496625672 or via chat through the website www.scaliagroup.com to receive all necessary instructions and must then inform Scalia Group by email at info@scaliagroup.com .
6.1 Information regarding the right of withdrawal (art. 52 of Legislative Decree 6 September 2005 n. 206 (“Consumer Code”)
The customer has the right to withdraw from the contract, without giving any reason, within 14 days. The withdrawal period expires after 14 days from the day on which the customer or a third party, other than the carrier and designated by the customer, acquires physical possession of the last good ordered. In the case of a contract relating to multiple goods ordered by the customer in a single order and delivered separately, the 14-day period starts from the day on which the customer or a third party, other than the carrier designated by the latter, acquires physical possession of the last good. To exercise the right of withdrawal, it is necessary to inform Scalia Group (Scalia Group Srl, via Maresciallo Caviglia 10, 90141 Palermo, tel. +39 3496625672, e-mail: info@scaliagroup.com ) of the decision to withdraw from this contract by means of any explicit declaration to that effect (for example, with a letter sent by post or e-mail). Scalia Group will promptly send a confirmation of receipt of the withdrawal on a durable medium (e.g. by e-mail).
6.2 Effects of withdrawal
Following withdrawal from this contract, Scalia Group will refund all payments made by the buyer, excluding delivery costs incurred for the return of the product (and with the exception of any additional costs resulting from the choice of a type of delivery other than the standard one offered by Scalia Group at the time of purchase), without undue delay and in any case no later than 14 days from receipt of the products subject to withdrawal. Such refunds will be made using the same payment instrument used by the customer during the purchase, unless otherwise agreed. In any case, the customer will not have to bear any costs as a consequence of such refund. The refund cannot be issued before receipt of the products subject to return. The Products must be returned:
- properly packaged in their original packaging, not ruined, damaged or soiled and equipped with all accessories, instructions for use and documentation;
- equipped with a transport document showing the order number, name, surname and address so as to allow Scalia Group to identify the customer;
- without obvious signs of use, other than those compatible with carrying out a normal test of the item (they must not show signs of prolonged use or in any case exceeding the time necessary for a test and must not be in such a condition as to not allow for resale).
If the returned product does not comply with the provisions of the previous paragraph, the withdrawal will not be effective. The costs of returning the goods are borne by the customer. The customer is responsible for any decrease in the value of the goods resulting from handling of the goods other than that necessary to establish the nature, characteristics and functioning of the products themselves. Scalia Group is not responsible for damage, loss, theft and manipulation of the goods sent by the customer for return.
7. Refunds
7.1 Refunds are credited directly to the account or payment instrument used at the time of purchase. For payments made by bank transfer, the refund will be made to the account used for payment. For payments made by Paypal or credit card, the refund will be made to the Paypal account or credit card used during the purchase. For payments made by cash on delivery, the refund will be made by bank transfer to the current account that the customer will indicate to Scalia Group. If a gift voucher was used for the order, Scalia Group will issue a voucher of equal value. All refunds will be net of the contribution for shipping costs where applicable (Scalia Group Privé). Any additional costs due to storage, change of address and refusal of a package are entirely borne by the recipient and will be deducted from the refund.

9. Warranty for defects and non-conformities of the products and additional information
9.1 The rules of the Scalia Group apply to purchases made on Scalia Group. Consumer Code on the subject of warranty for defects and non-conformities of products . The customer will therefore be recognized the rights referred to in art. 130 of the Consumer Code and such rights must be exercised within the terms referred to in art. 132 of the same Consumer Code.
9.2 These GTC can be consulted on the website www.scaliagroup.com and can be saved using the relevant browser command (usually, File -> Save As).
